on june 24, 2011, new york s legislature legalized same-sex marriage marriage equality act. conservative party of new york stated withdraw support candidate voted in favor of bill. new york s electoral fusion, republican candidates rely on endorsement of conservative party. senators roy mcdonald, james alesi, mark grisanti, , stephen saland each voted in favor of marriage equality act, , endorsed conservative party. carl paladino, 2010 republican gubernatorial nominee, announced financially primary candidates against both grisanti , saland, assemblywoman janet duprey, supported act. sen. alesi opted retire rather face primary challenge, sen. mcdonald lost republican primary kathy marchione, sen. saland won primary, lost general election democrat terry gipson margin of approximately 2,000 votes when primary challenger, neil di carlo, remained on ballot on conservative line , acted spoiler. of 4 republican state senators voted in favor of marriage equality act, 1 re-elected state senate in 2012; sen. grisanti prevailed in both primary , general election. asm. duprey won re-election.

46th district: newly created district stretching montgomery county south ulster county. assemblyman george amedore ran on republican line. coeymans town councilman thomas dolan, duanesburg central school board of education president cecilia tkaczyk, , monica arias miranda of hispanic coalition of new york sought democratic nomination. tkaczyk prevailed in democratic primary. on january 17, 2013, final recount certified, , tkaczyk declared winner 19 votes.
55th district: incumbent republican senator james alesi announced not seek re-election, citing concerns ability prevail against primary challenger following controversial 2011 vote in favor of same-sex marriage. monroe county legislator ted o brien ran democrat, , assemblyman sean hanna received republican nomination. o brien defeated hanna.
